The terms and conditions set forth here have been updated and will be effective from May 2018.
This page sets out the terms of use (the "Terms of Use") under which the user (the "User") may use the Sites and Services of Smarteris S.r.l. (hereinafter "STUPENDIO™"), with registered office at Via Ippolito d'Aste 7/5, 16121, Genoa (Ge) and VAT number 0265970992.
These Terms of Use constitute a binding agreement between the User and Smarteris S.r.l. and are deemed accepted by the User whenever they access or use the Site or Services. If the User does not accept the Terms of Use set forth herein, they may not use the STUPENDIO™ Sites and Services.
"STUPENDIO™ Sites" or "STUPENDIO™ Platforms" refer to websites, blogs, and social networks controlled, even partially, by Smarteris S.r.l. (including, but not limited to, www.stupendio.it, www.stupendio.com) which also include the services offered by Smarteris S.r.l.
"STUPENDIO™ Services" are defined as the applications and services offered by Smarteris S.r.l., including an online service for posting and searching for job opportunities.
"STUPENDIO™ Content" is defined as design, text, graphics, images, videos, information, logos, trademarks, button icons, software, audio files, and other types of content.
"Posting" and "Applying" refer to the information that the User submits, posts, or displays on the STUPENDIO™ Site.
STUPENDIO™ reserves the right to modify these Terms of Use at any time by posting an updated version on its web page. Users are encouraged to periodically visit this page to review periodic updates to the Terms of Use, as they are binding on the User.
Users who violate these Terms of Use may face suspension or termination of access and use of the Sites, at the sole discretion of STUPENDIO™.
To visit or use the Sites, the User must be at least 16 years old. If the User is under 18 or otherwise a minor under applicable law in their country, they must use the STUPENDIO™ Site under the supervision of a parent, legal guardian, or another responsible adult.
Content or STUPENDIO™ Profiles cannot be used to determine consumer eligibility for: (a) credit or insurance for personal, family, or household purposes; (b) employment; or (c) government license or benefits.
STUPENDIO™ authorizes the User, under the terms of these Terms of Use, to access and use the Sites and STUPENDIO™ Content and to download and print the content available from the STUPENDIO™ Sites for personal, non-commercial purposes only.
All STUPENDIO™ Users agree not to:
STUPENDIO™ should not be considered an employer concerning the use of a STUPENDIO™ Site and is not responsible for employment decisions made for any reason by the entity posting the job listings.
The User may not post job listings that:
When registering on a STUPENDIO™ Site, the User will be required to create an account and provide STUPENDIO™ with certain information, including, but not limited to, a valid email address.
The User acknowledges and agrees that they are solely responsible for the form, content, and accuracy of any CV or material uploaded to the STUPENDIO™ Sites.
The User understands that all information, data, text, software, music, sounds, photographs, graphics, videos, advertisements, messages, or other materials submitted, posted, or displayed by the User through each STUPENDIO™ Site ("User Content") is the sole responsibility of the person who generated such User Content.
By submitting, posting, or displaying User Content through STUPENDIO™, the User grants STUPENDIO™ a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, distribute, and publish the User Content through STUPENDIO™.
If the User believes that copyrighted or trademarked material has been uploaded, posted, or copied on a STUPENDIO™ Site and is accessible on the Site in a manner that constitutes a copyright or trademark infringement, the User must contact STUPENDIO™ at [email protected].
STUPENDIO™ Sites serve, among other things, as a meeting point between (i) employers who post job opportunities and search for and evaluate potential candidates, and (ii) candidates who post resumes and profiles and search for and evaluate companies and job opportunities. Specifically:
The User must consider that risks may arise, including but not limited to physical harm, when engaging with third parties, minors, or individuals acting under false pretenses. The User assumes all risks associated with interacting with other Users contacted through the STUPENDIO™ Sites.
TO THE EXTENT PERMITTED BY LAW, STUPENDIO™ DOES NOT GUARANTEE THAT THE SITE AND STUPENDIO™ SERVICES WILL BE ERROR-FREE OR THAT THE SITE OR SERVER WILL BE FREE OF VIRUSES OR OTHER TECHNICAL DEFECTS OF ANY KIND. THE STUPENDIO™ SITES AND CONTENT ARE PROVIDED "AS IS," WITHOUT ANY WARRANTY FROM THE COMPANY.
The User agrees to indemnify and hold harmless STUPENDIO™, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, actions, or demands, including but not limited to legal and accounting fees, arising from User Content or other materials provided by the User to the STUPENDIO™ Site.
These Terms of Use are governed by Italian law. Any disputes arising in connection with these Terms of Use shall be subject to the jurisdiction of the Court of Genoa.
The partial invalidity, nullity, and/or unlawfulness of these Terms of Use or individual clauses, as determined by the competent judicial authority, shall not render the remaining provisions invalid, null, or unlawful, and they shall remain in effect.
If the User accesses the STUPENDIO™ Sites via a mobile device, the User agrees that information about their use of the STUPENDIO™ Sites through their mobile device and mobile service provider may be communicated to STUPENDIO™.
These Terms of Use shall remain in effect for the entire period of the User’s use of the STUPENDIO™ Sites. STUPENDIO™ reserves the right, at its sole discretion, to take any legal remedies available, including removing User Content from the STUPENDIO™ Sites and immediately terminating the User’s registration.
